These Terms of Service (“Terms”) govern your access to and use of DailyWell (“we”, “us”, “our”, “Company”) and all related wellness programs, content, and features we provide (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

DailyWell is NOT a medical provider, medical device, or medical treatment. We offer a wellness sleep improvement program, not healthcare services. The Service does not diagnose, treat, cure, or prevent any disease, disorder, or medical condition.
If you have a diagnosed medical or mental health condition — including but not limited to PTSD, post-traumatic stress disorder, anxiety disorders, depression, sleep apnea, insomnia disorder, bipolar disorder, schizophrenia, or any other psychiatric or physical health condition — you must consult your licensed healthcare provider before starting this or any wellness program. DailyWell is not a substitute for professional medical advice, diagnosis, or treatment.
There have been reports in wellness literature indicating that sleep and mindfulness interventions may, in rare cases, have unintended effects on individuals with certain psychiatric conditions. If you experience worsening symptoms, distress, or adverse effects while using DailyWell, discontinue use immediately and consult a healthcare professional.
The Service is intended for individuals who are at least 18 years of age. By using the Service, you represent and warrant that you are 18 or older. We do not knowingly collect personal information from or provide the Service to individuals under 18. If you become aware that a minor is using the Service, please contact us at support@dailywell.world.
DailyWell is a technology platform that delivers personalized sleep wellness programs based on quiz responses. The Company is not a healthcare provider and does not employ licensed medical professionals in the delivery of the Service. The content, protocols, and materials provided through the Service are for general wellness and educational purposes only.
Specifically, the Service:
Always seek the advice of a qualified healthcare professional with questions regarding a medical condition, and never disregard or delay seeking professional advice because of something you read or received through the Service.
If you indicated during onboarding that you have a diagnosed condition (including PTSD, anxiety disorder, depression, or sleep apnea), you expressly acknowledged and agreed to our Medical Notice at the time you entered the program. That acknowledgement is incorporated into these Terms. By continuing to use the Service, you reaffirm that:
DailyWell plans are sold as recurring subscriptions. Your plan will automatically renew at the end of each billing period at the same price unless you cancel before the renewal date. You may cancel at any time through your account settings or by contacting support@dailywell.world. Cancellation takes effect at the end of the current billing period.
All prices are shown in USD and include applicable taxes where required by law.
If you complete the program as directed during the first 30 days and do not experience any improvement in your sleep, we will issue a full refund. To request a refund, email support@dailywell.world within 30 days of your purchase. Refunds are processed within 5–10 business days.
Your subscription is for personal, non-commercial use only. You may not share credentials, redistribute content, or resell access without our written permission.
All content — including programs, protocols, copy, images, and software — is the intellectual property of DailyWell and is protected by applicable copyright and trademark law. You may not reproduce, modify, or distribute any content without prior written consent.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SPECIFIC HEALTH OUTCOME WILL BE ACHIEVED. INDIVIDUAL WELLNESS RESULTS VARY AND ARE NOT GUARANTEED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DAILYWELL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify and hold harmless DailyWell and its affiliates, officers, agents, and employees from any claim, demand, loss, or damage (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; or (c) your negligence or wilful misconduct.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be settled by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property or confidentiality violations.
We may update these Terms from time to time. Material changes will be communicated by email or a notice on our website at least 14 days before taking effect. Continued use after that date constitutes acceptance of the updated Terms.
